Corporate Restructuring Services - FAQs

  • The NCLT handles cases related to corporate disputes, insolvency and bankruptcy proceedings, mergers and amalgamations, oppression and mismanagement, and the restoration of struck-off companies. It primarily deals with matters under the Companies Act, 2013, and the Insolvency and Bankruptcy Code, 2016.

An insolvency petition can be filed by financial creditors, operational creditors, or corporate debtors themselves. The petition is filed before the NCLT to initiate the Corporate Insolvency Resolution Process (CIRP) against a defaulting company.

If a party is dissatisfied with an order passed by the NCLT, they can file an appeal before the National Company Law Appellate Tribunal (NCLAT) within the prescribed time frame (usually 30 days from the date of the order). Our team assists in preparing and filing appeals to ensure a strong legal representation.
